A careful investigation starts with the condition and the timeline

A fall at a store, restaurant, apartment building or other property can cause lasting injuries. A claim depends on more than where the fall occurred: the condition, who controlled the property, what they knew or should have known, and how the incident caused your injuries all matter.

The Right Law Firm, P.A. evaluates slip-and-fall, trip-and-fall and other premises-injury claims from our Plantation office. We help clients in Broward, Miami-Dade and Palm Beach counties, with assistance in English, Spanish and Portuguese.

What evidence helps explain a fall?

  • The condition itself: photographs of the liquid, uneven surface, broken step, lighting or other condition you believe caused the fall, taken safely and without altering the scene.
  • The timeline: when you arrived, where you walked, what you noticed, who witnessed the incident and what was said afterward. Separate what you observed from what you later learned.
  • Business and property records: incident reports, available surveillance, inspection or cleaning records, maintenance records and information about prior complaints may help explain what happened.
  • Your injuries and losses: medical records, photographs, work records and receipts that accurately document the consequences of the incident.

Report the incident to an appropriate property representative when you can, and keep a record of who received the report. Preserve the footwear and clothing involved. Do not change evidence or assume a business will retain video indefinitely.

Does a fall automatically make the business responsible?

No. The legal duties and proof depend on the circumstances. For a slip on a temporary foreign substance in a business establishment, section 768.0755, Florida Statutes, requires proof of actual or constructive knowledge and that the business should have acted to remedy the condition. Evidence about how long a condition existed or how regularly it occurred can matter. Other property conditions may involve different rules.

Why early investigation matters

The substance may be cleaned, the condition repaired, or video overwritten. We evaluate what evidence is available, who may possess it, and appropriate preservation requests. The owner, tenant, manager or a contractor may have different responsibilities; the name on the building is not always the complete answer.

A store incident report, photograph or witness statement can be useful, but no single item guarantees a result. We assess liability, causation, injuries, insurance and potential defenses together.

What should I bring to a consultation?

Bring the date, time and exact location; photographs and videos; witness contact information; any report or claim number; medical information; and correspondence from the property or insurer. If you do not have those items, start with what you know.

The initial consultation is free. Before you decide whether to hire the firm, we explain the proposed attorney fees, case costs, and who is responsible for those costs under the written agreement.
